Terms & Conditions for all bookings

Bookings, Payments and Cancellation

Any person making a booking (lead guest) agrees to adhere to the terms and conditions which form part of the holiday agreement with Axe Valley View.

The lead guest who makes the booking or completes the booking online confirms that: he or she is authorised to agree the booking conditions on behalf of all persons included in the booking form, including those substituted or added at a later date; the signatory is over eighteen years of age, and agree to take responsibility for their party occupying the property.

The Contract for a short-term holiday rental will be between Axe Valley View and the person making the booking and all members of the holiday party. Bookings are non-transferable to a 3rd party. The contract will be subject to the booking conditions following and must be complied with:

On booking you will receive a booking confirmation email with details of how to make payment by bank transfer or Paypal. Payment of the deposit for your trip must be made within 24 hours of the booking in order to secure your booking. Your confirmation email will also confirm when the balance will be due.

All bookings via our online system should be treated as provisional until you receive a personal confirmation from us via email that your payment has been received.

The payment can be refunded according to the following cancellation conditions:

· If the booking is cancelled less than 14 days before arrival then a charge equal to the first night of the stay will be made.

· If the booking is cancelled less than 14 days before arrival then a charge equal to the first night of the stay will be made.

· If the booking is cancelled less than 7 days before arrival then a charge equal to the full booking will be made.

· In the event of a no show or booking reduction (after arrival date) a charge equal to the first 3 nights of the stay will be taken and the remaining amount will be refunded.

The prices featured on the website and offers are not binding; we reserve the right to modify these prices. At the time of booking, you will be informed of the prices applicable. The price stated on the confirmation email is binding. We only accept bookings from persons over 18 years of age and we reserve the right, at all times, without statement of reasons, to refuse or cancel a booking.

We realise that sometimes plans change and if you have to cancel your holiday, please let us know as soon as possible and we will try to work with you to find the best solution.

We strongly recommend that you have holiday insurance to cover unexpected cancellation. We recommend your holiday insurance covers any potential losses.

In the unlikely event of the accommodation not being available due to fire, flood or other unforeseen circumstances, we cannot accept liability or responsibility for any loss, but the full cost of the holiday will be refunded within 14 days – please refer to our ‘Force Majeure’ section.

Force Majeure – Force majeure on the side of Axe Valley View exists if the implementation of the agreement is entirely or partially, temporarily, or permanently, prevented due to circumstances which are beyond our control, these circumstances shall include (but not be limited to) war, terrorism, riots or civil unrest, industrial action, flooding, natural disaster, epidemics, health risks or such similar events (“Force Majeure”). We recommend that you have appropriate holiday insurance cover.

Overseas Bookings
Overseas guests may pay by international electronic transfer. Any charges from payments from overseas will be passed on to the guest.

Security/Damage
We do not take a security deposit for your stay but do ask all our guests to take the same care of our property as you would for your own.
If there are any breakages or damages caused during your stay, please let us know. Please leave the cabin in a tidy state with all washing up completed and bottles and rubbish in the bin or recycling container.

Arrival & Departure Times
We ask that you arrive on your arrival date after 4:00pm.

Guests are requested to check out by 10:00am on the date of their departure.

Accommodation Additional Notes

The accommodation is not suitable for babies, infants or children and no dogs are allowed.

Smoking is not permitted at any time within the cabin or on the deck.

Safety Notes

The access to the cabin is via a sloped gravel path and there are a couple of steps up to the cabin deck and entrance.

Depending upon weather conditions we have cold, wet, and slippery surfaces, so please make sure that your party are aware of this and wear suitable footwear.

We love to keep the skies dark, so outdoor lighting is restricted to low level path lights on a sensor.
The cabin has a smoke detector, a fire extinguisher with exits at the front and rear of the cabin. We ask that candles are not lit in the cabin or on the deck (due to fire risk).

Responsibility
By booking and coming to Axe Valley View you agree to be responsible for all of your party and your own welfare and to take all reasonable precautions against personal injury, injury to others and damage to facilities and cabin.

Cars

Cars can be parked in our private driveway. Although we are in a remote and relatively crime-free area, we can’t take responsibility for vehicles or contents in the driveway. Please let us know if you are bringing more than one car per booking.

We take every care to ensure that you have a safe and enjoyable holiday but cannot be held liable for any accidents or consequential loss or damage to the guest’s possessions on the property or land. Or from any loss, damage, or expense arising from industrial action, terrorist activity, adverse weather conditions or any other event outside our control.

Electric Car Charging

Unfortunately, we are unable to offer electric car charging.

Additional Cleaning/Littering
All cleaning under normal circumstances is included in the cost of your stay. If additional cleaning of the cabin is required, including but not limited to: washing up, additional cleaning of the interior or fixtures and fittings or removing rubbish or recycling from the lodge, then we reserve the right to charge for this work at a rate of £10 per hour.

Guest Behaviour
The guests have the right to occupy the property for the paid holiday duration only. Guests undertake to behave in an appropriate and legal manner with due respect to the owner, the property and other guests and their property. If any guest behaves inappropriately or improperly (of which the owner will be the final judge on their property), or illegally, the owner reserves the right to ask the guest and their party (at their discretion) to leave the property before the end of the holiday period. Any refund for so doing will be at the discretion of the owner. In addition, the owner reserves the right to sue the guest for any loss, harm, damage, or injury caused to the owner, the property or to other guests and/or their property.

Legal Responsibility
Axe Valley View accepts no liability or legal responsibility for theft, loss, or damage, of whatever nature, during or as a result of a stay. The guest and those who accompany them, are collectively responsible for all loss and/or damage which arises, for Axe Valley View and, or any third party as a direct or an indirect consequence of their stay, whether this was caused through actions or refraining from actions by themselves or by third parties, as well as all damage which is caused by parties which they have under their responsibility. If you leave the cabin late or in an improper condition, additional costs can be charged.

Clause – In the event that a court finds that any part of these terms and conditions is illegal or void, the illegal or void part will be severed from the remainder of the Booking Conditions/Terms and Conditions, which will continue to be valid and binding and have full force and effect.

Breach of Conditions
If there is a breach of any of these Booking Conditions/Terms and Conditions by the guest or any of their party, the owners reserve the right to re-enter the property and cease the holiday immediately and ask the guest and their party to leave.

Complaints
If you have a genuine complaint, please take this up with the owner immediately, to allow the matter to be resolved as soon as possible. Should the complaint not be settled to your satisfaction, then you have the option, up to 14 days after your departure to submit the complaint in writing or by email to us.

Disclaimer for our South West Coast Path Offer Offers

We want you to enjoy your holiday and your walks so please choose your sections to walk wisely and come fully equipped for the weather and walking conditions so that you can make the most of your trip and enjoy your stay.

All guests are very welcome to use the information provided to help to guide them on day walks on the South West Coast Path. There is no additional charge for the information provided therefore it does not form part of your holiday contract with us. Undertaking any walking activities is your responsibility and is done so at your own risk. We strongly recommend that you take out travel insurance against the risk of accidents and your stay being cut short.

This disclaimer is published to protect Axe Valley View from any legal action that might be brought by walkers who get injured when following our suggested routes.

Sections of The South West Coast Path include steep climbs and descents, uneven ground, varied terrain and stile crossings, while others are more gentle. It is your responsibility to select routes which match your level of fitness and walking experience.

It is your responsibility to bring appropriate outdoor clothing and footwear suitable to the nature of the walks you choose and to choose routes that they are appropriate to your fitness levels and capability.

We will supply maps and guidance on walking sections of the South West Coast Path, but the walks are self-guided so you must be confident at map reading and know how to use a compass before you set off.

The weather in the UK can change quickly and is often more unpredictable on the coast. Changes in weather conditions can effect visibility and walking conditions. It is important to check the weather forecast before setting off and carry an appropriate selection of clothing with you each day in case there are unexpected changing conditions. Do not attempt to walk if there are weather warnings in place.

Those using our directions and guidance do so at their own risk. We can take no responsibility for accidents and injury that might happen along the way. Walking in the countryside and along the coast along marked trails is mostly low risk, but accidents can happen.

Accidents and ill health

Walkers could slip on mud or ice, they could injure themselves when climbing stiles, be cut by brambles, stung by nettles, bitten by insects, or chased and possibly hurt by livestock.

Some surfaces, such as bridleways, which have been repaired by landowners with rubble, might contain sharp items which could injure feet.

Some gates on public rights of way might have sharp metal edges. Paths and tracks are often fenced with barbed wire or electric fences.

We can take no responsibility for injuries to walkers caused by the surface or obstacles encountered along public rights of way or permissive paths.

If walkers encounter a 'Bull in the Field' sign we suggest trying to find an alternative route along a public right of way.


All walkers crossing a livestock field do so at their own risk.

There is the danger of being hit by traffic in sections that follow a country lane or road without a pedestrian pavement. Please take care and watch out for traffic.

It is important to stay hydrated. The amount of water you need will be different for each person, so please prepare for a walk by making sure you have enough fluid.

If a walk has a total elevation of 120m that will be the equivalent of climbing up and down 40 flights of stairs, so please bear this in mind when selecting a route

Changes to routes

The suggested routes follow public rights of way and permissive paths. Routes never involve the need to trespass on private land. If you stray from the way marked routes or those shown on the maps in order to follow an unofficial shortcut you do so at your own risk.

All the public rights of way we suggest are correct at the time we published the information. We use the most up to date information from The South West Coast Path Association and Ordnance Survey public rights of way maps to check the status of all footpaths, bridleways and byways before we provide information. However, some routes might be diverted or changed over time, sometimes because of new development or cliff falls. Old wooden stiles, gates, and footbridges which might have been used as landmarks could change.

Privacy Statement

By completing a booking and thereby agreeing to our terms and conditions you are consenting to the below use of your data.

We take the preservation of your privacy seriously and are committed to letting you know how we use your personal information and to using your data in a responsible manner.

Information About You

We will collect and collate personal information from you when you enquire about our service, make a booking via phone or online, or engage with us via our contact forms. This information may include your name, title, email, postal address and telephone number.

Our Use Of This Information

Your personal information will be used to process your requests, to provide you with our services, to provide you with information relating to our services and all other services in which we think you may be interested.

The information will be for the use of Axe Valley View only and not sold or passed to any third party other than our data/booking processing company who are obligated to keep it secure for our access only.

We do not hold or store any information regarding your bank accounts or credit cards.

If you would like us to correct or update any information, or if you would like information deleted from our records, then please email us at alison@axevalleyview.co.uk. You have the right to access any information that we hold relating to you (Data Protection Act 1998).

Security

Axe Valley View will take all reasonable precautions to prevent the loss, misuse, or alteration of information you give us.

Communications may be sent by e-mail or other methods. For ease of use and compatibility, communications (other than payments where applicable) will not be sent in an encrypted form.

While we endeavour to keep our systems and communications protected against viruses and other harmful effects, we cannot bear responsibility for all communications being virus-free.

Disclosure of information

We will never pass your information on or disclose it to third parties other than in the event that we are legally required by law to disclose your personal information.

This privacy policy may be updated from time to time, so please check back periodically. Links within our sites to other websites are not covered by this privacy policy.

Privacy Statement from Free to Book (our third part booking system provider)

Freetobook is booking software used by accommodation providers to enable their customers to make online bookings and manage those bookings.

This document applies to the processing by freetobook of personal data collected by properties using freetobook online booking system in relation to the provision of accommodation by those properties.

Your Personal Data

Properties using freetobook as their booking engine, collect and store information that you give when you make a booking. You are asked for your name, address, telephone number and email along with payment information and “the names of any guests travelling with you”. This may also include your IP address. This information is stored in the freetobook System in order to process your booking. You may be contacted by the Property you have booked with in relation to your booking.

Your data is also stored after you have stayed but will be kept no longer than necessary in order to comply with legal obligations and for properties to welcome your repeat business.

Data processed directly by third parties

If you provide payment information, this will be processed directly by secure PCI Level 1 compliant payment gateway providers.

Joint Controllers

In the context of providing booking software to accommodation providers to facilitate online booking, freetobook and the accommodation provider shall together operate as joint data controllers for the processing of your personal data.

Security Procedures

In accordance with General Data Protection Regulation (GDPR), freetobook observes reasonable procedures to prevent unauthorised access and misuse of personal information. We use appropriate business systems and procedures to protect and safeguard any personal information given to us. We also use security procedures and technical and physical restrictions for accessing and using the personal information on our servers. Only authorised personnel are permitted to access personal information in the course of their work.

Control of your Personal Data

You have the right to access data that is stored on behalf of properties taking bookings via freetobook system. You need to email or write to the property you booked with to request an overview of your personal data.

You can also contact the property you booked with on freetobook System if you believe that the personal information they have for you is incorrect, if you believe that they are no longer entitled to use your personal data or if you have any other questions about how your personal information is used or about the Privacy Statement. You need to email or write to the property you booked with.

Reviews

You may also be asked to send feedback after your stay in order for the property to further improve their service. Your email address will be used for this purpose. If you complete a review it may be posted on the property website, facebook page, twitter or google plus. However, no identifying details will ever be attached to a review posting.

To Process your information as described above, we rely on the following legal bases:

Performance of a contract. The storage of your information may be necessary to perform the contract that you have with the accommodation provider you are booking with.

Legitimate Interests. We may use your information for our legitimate interests, such as for administrative, fraud detection and legal purposes.

Cookies

A cookie is a small amount of data that is placed in the browser of your computer or on your mobile device. These cookies are used only to help you make a smooth booking and contain information like the date searched and language of booking. There is a difference between session cookies and persistent cookies. Session cookies will only exist until you close your browser. Persistent cookies have a longer lifespan and are not automatically deleted once you close your browser. We use persistent cookies in Google Analytics to analyse visitor traffic and behaviour.
